These past few weeks have been such a whirlwind that it’s hard to believe that it was just earlier this month that the MAGA-packed Supreme Court ruled presidents have immunity from prosecution for all crimes committed while in office. This particular ruling was done in the service of Donald Trump, who will go to any length to escape accountability for attempting to overturn the 2020 election and inciting the January 6 insurrection.
Now Democrats are fighting back to protect our freedoms and democracy. This week, a group of House Democrats introduced a constitutional amendment to reverse the Supreme Court’s ruling.1 And as part of a sweeping set of recommendations to address Supreme Court corruption, President Biden affirmed his support for a constitutional amendment to assert that no one is immune from federal criminal indictment, trial, conviction, or sentencing by virtue of having previously served as president.2
The consequences of the Supreme Court’s ruling are grave. First, it halted the remaining three trials against Trump, denying the American people verdicts ahead of November’s election, and interfered with Trump’s sentencing after being convicted on 34 felony counts in New York.
The court’s ruling also opens the door for authoritarian rule, setting Trump up to consolidate power in order to do whatever he wants without any repercussions. He says he’ll be a dictator on day one, and we should believe him.3 Between presidential immunity and Project 2025—another Trump presidency would threaten our democracy.
No one should be above the law, not even a president. Congress must pass a constitutional amendment to reverse the Supreme Court’s bogus presidential immunity ruling.
The MAGA-packed Supreme Court decided that presidents are immune in order to help Trump escape accountability, creating chaos in the midst of four trials for a range of crimes he committed while president. Congress must aggressively fight for this decision to be reversed, through all means and possibilities.
Passing a constitutional amendment requires a strong majority of support in both the House and the Senate that we don’t currently have. But while we are working to elect Democrats up and down the ballot to make this possible, it’s imperative that we show our lawmakers that there is a groundswell of support for them to reverse the court’s dangerous ruling. It’s a critical step toward preserving our democracy and freedoms.
When the Supreme Court has made disastrous rulings throughout history, it has fallen to the people and our elected representatives to correct the course of our nation—as we have by ending slavery, expanding voting rights, imposing term limits on the presidency, and so much more. Now it is incumbent upon leaders of both parties to right this wrong by pursuing an amendment to our Constitution to reaffirm that no one is above the law.
Trump wants one set of rules for himself and another for the rest of us. We must demand that Congress come together to pass a constitutional amendment that affirms equal justice for all and that no one is above the law.
